STL Fencing Club – Terms & Conditions

1. Assumption of Risk & Waiver of Liability

I acknowledge that participation in fencing and related activities involves inherent risks, including but not limited to falls, collisions, physical contact, use of fencing equipment, and other conditions associated with physical sport. These risks may result in injury, illness, or other harm.

I voluntarily assume all risks, known and unknown, associated with participation at STL Fencing Club. I hereby release, discharge, and hold harmless STL Fencing Club, its owners, directors, officers, employees, coaches, volunteers, agents, and representatives from any and all claims, liabilities, demands, or causes of action arising out of or related to any injury, illness, damage, or loss that may occur as a result of participation in Club activities, whether on or off the premises, regardless of cause, including negligence, except in cases of gross negligence or willful misconduct as recognized under Missouri law.

2. Adherence to Club Rules & Code of Conduct

All participants agree to:

Follow all safety protocols and equipment guidelines, including the safe handling of fencing weapons. Specifically, weapons should never be pointed at others’ faces or used in an unsafe manner, and masks should always be worn when appropriate.
Refrain from cheating or engaging in collusion during fencing matches or any other Club activities.
Exhibit good sportsmanship at all times, including refraining from arguing with referees, coaches, or other participants, and not engaging in unsportspersonlike behavior such as throwing equipment, using inappropriate language, or creating a hostile environment.
Treat fellow members, coaches, and staff with respect, maintaining a positive and supportive atmosphere at all times.
Use only approved fencing gear and ensure that equipment is in safe, working condition for both personal and public safety.
Abide by all instructions from Club staff during practices, classes, and events, particularly regarding safety rules and game conduct.
Report any unsafe conditions or hazards to the Club staff immediately.
Respect the decisions of referees and coaches, and understand that their authority is vital for maintaining a safe and fair environment.
No member shall engage in any behavior or actions that may endanger the safety or well-being of themselves or others.

The Club reserves the right to suspend or terminate membership without refund for violations of these rules, including unsafe conduct, cheating, collusion, unsportspersonlike behavior, or any action deemed detrimental to the safety or reputation of STL Fencing Club.

3. Medical Authorization

In the event of injury or medical emergency, I authorize STL Fencing Club staff to obtain necessary medical treatment for myself or my child. I agree to be responsible for all associated costs.

4. Photo & Video Release

I grant STL Fencing Club permission to take photographs and video recordings during Club activities for use in promotional materials, social media, website content, and marketing purposes. I understand that I will not receive compensation for such use. If I do not wish to be photographed or recorded, I will provide written notice to the Club in advance.

5. Payment & Cancellations

Memberships, class fees, and event registrations are non-refundable unless otherwise stated in writing by the Club.
Missed classes cannot be refunded but may be rescheduled at the discretion of the Club.
The Club reserves the right to cancel or reschedule activities due to weather, safety concerns, or other circumstances beyond its control.
In exceptional cases, such as medical emergencies or relocation, partial refunds may be considered at the Club’s discretion.

6. Indemnification

I agree to indemnify, defend, and hold harmless STL Fencing Club from any and all claims, liabilities, damages, and costs arising from my participation in Club activities, including but not limited to injuries, damages, and actions taken by me or my child.

7. Alcohol & Drug Use

The use of alcohol or illegal substances is strictly prohibited during Club activities, including practices, matches, and events. Violators may be suspended or expelled from the Club.

8. Terms Modifications

STL Fencing Club reserves the right to modify or update these Terms & Conditions at any time. All modifications will be posted on the Club’s website, and participation in activities following such updates signifies agreement to the revised terms.

9. Governing Law & Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Missouri. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in St. Louis, Missouri.

10. Agreement

By accessing or using the STL Fencing Club website, registering for membership, or participating in any activities offered by the Club, you confirm that you have read, understood, and voluntarily agree to these Terms & Conditions, including the waiver of liability and adherence to Club rules. If registering a minor, you confirm that you are the parent or legal guardian and have the authority to agree on their behalf.

Your continued use of the STL Fencing Club website and participation in any activities constitutes your agreement to these Terms & Conditions.
